To further standardize the administration of pesticide export, in accordance with the Regulations on Pesticide Administration and Measures for the Administration of Pesticide Registration, the Ministry of Agriculture and Rural Affairs hereby sets forth the provisions on the registration administration of pesticides exclusively for overseas use as follows:
I. Scope of Application for Registration of Pesticides Exclusively for Overseas Use
Where a pesticide product has obtained registration in a foreign country/region or import approval from the importing country/region, pesticide manufacturers may apply for registration of such product exclusively for overseas use if any of the following conditions is met:
1. If the active ingredient has not obtained domestic pesticide registration, the applicant may apply for registration of the corresponding technical material (parent drug) and formulations exclusively for overseas use concurrently, or apply for registration of the technical material (parent drug) first, followed by registration of formulations exclusively for overseas use.
2. If the active ingredient has obtained domestic registration for its technical material (parent drug), the holder of the domestic registration certificate may apply for registration of technical materials (parent drug) with different contents of the same active ingredient exclusively for overseas use.
3. If the active ingredient has obtained domestic pesticide registration, the applicant may apply for registration of single-ingredient formulations or mixed formulations containing the said active ingredient exclusively for overseas use. Such application shall not be subject to the provisions on pesticide content, ratio and number of active ingredients stipulated in Article 8 of the Measures for the Administration of Pesticide Registration and Announcement No. 345 of the Ministry of Agriculture and Rural Affairs.
4. Other circumstances as prescribed by the Ministry of Agriculture and Rural Affairs.
Pesticide manufacturers submitting applications shall have a production scope covering the corresponding active ingredients or formulations (except for active ingredients without domestic pesticide registration), and hold at least one valid domestic pesticide registration certificate.
II. Documentation Requirements for Registration of Pesticides Exclusively for Overseas Use
1. Pesticide registration application form.
2. Product registration dossiers
(1) Product overview, abstract of overseas registration documents, Material Safety Data Sheet (MSDS) and other relevant documents. For formulations, a source statement of the technical material (parent drug) issued by the holder of the technical material (parent drug) registration certificate shall also be provided, except where applications for the technical material (parent drug) and formulation registration are submitted concurrently in accordance with Item 1 of Article I herein.
(2) Product chemistry documents: For technical materials (parent drug), product quality standards and full component analysis test reports shall be provided. For formulations, product quality standards and quality inspection reports shall be provided. For technical materials (parent drug) whose active ingredients have not obtained domestic registration, physical and chemical property data of the active ingredient and technical material (parent drug), basis for naming the Chinese common name, and reference standards shall also be submitted.
(3) Toxicological documents: Test reports on acute oral, dermal and inhalation toxicity, as well as information on poisoning symptoms, first aid and treatment measures. A summary of genotoxicity test reports shall additionally be provided for technical materials (parent drug).
3. Copy of the pesticide production license and statement on holding valid domestic pesticide registration certificate(s).
4. Undertaking letter signed by the legal representative and affixed with the official seal of the enterprise, committing that the products will not be sold or used domestically.
5. Official documents proving approval for overseas use
(1) Where the product is regulated as a pesticide in the destination country/region, the pesticide registration certificate or equivalent certification issued by the competent authority of the destination country/region shall be submitted; labels shall be attached for formulation products.
If the applicant is not the holder or supplier specified on the aforesaid registration certificate or certification, supporting documents issued by the authority that issued the overseas pesticide registration certificate shall be provided.
(2) Where the product is regulated as a pesticide in China but not regulated as a pesticide in the destination country/region, import certification documents issued by the destination country/region and copies of relevant supply agreements shall be submitted.
III. Requirements for Variation of Registration for Pesticides Exclusively for Overseas Use
Applications for registration variation shall be submitted in compliance with the Requirements for Pesticide Registration Dossiers. Where additional or revised destination countries/regions are involved, corresponding documents proving approval for overseas use shall also be submitted.
IV. Requirements for Renewal of Registration for Pesticides Exclusively for Overseas Use
Applications for registration renewal shall be submitted in accordance with the Requirements for Pesticide Registration Dossiers, together with an explanation on the domestic registration status of the relevant active ingredient or similar formulations, corresponding documents proving approval for overseas use, and a copy of the pesticide production license.
1. After the active ingredient obtains domestic registration, the registration certificate for its technical material (parent drug) exclusively for overseas use may be renewed no more than once upon expiry. This restriction shall not apply to the holder of the domestic registration certificate for the relevant technical material (parent drug).
2. If similar formulations have obtained domestic pesticide registration, no new registration for the corresponding formulations exclusively for overseas use shall be approved. Existing registration certificates for such formulations exclusively for overseas use shall not be renewed upon expiry.
V. Miscellaneous Provisions
1. The technical review period for registration and variation of pesticides exclusively for overseas use is 6 months.
2. The serial number code for registration certificates of pesticides exclusively for overseas use is formatted as EX + year + four-digit serial number. Each certificate shall be marked with the words "Exclusively for Overseas Use" and the abbreviated name(s) of the destination country/region.
3. Products registered exclusively for overseas use may only be exported to the country/region specified on the registration certificate, except for products converted from domestic registration to registration exclusively for overseas use in accordance with relevant provisions of the Ministry of Agriculture and Rural Affairs.
4. Products registered exclusively for overseas use are prohibited from entrusted processing and repackaging, and shall not be marketed or used domestically. Any act of marketing or using such products within China shall be dealt with in accordance with the provisions on counterfeit pesticides.
5. This Announcement shall take effect on the date of issuance. Announcement No. 269 issued by the Ministry of Agriculture and Rural Affairs on June 8, 2020 is hereby repealed simultaneously.
